AGB

1. Scope: These Terms and Conditions apply to all services provided by Weekendwise, in particular to the rental of furnished apartments (short- and medium-term) as well as co-hosting and management services. Depending on the type of booking, the relevant sections of these Terms and Conditions apply in addition.

2. Contracting Parties & Conclusion of Contract: The contract is concluded between the guest or client and Weekendwise. For bookings made via platforms (e.g., Airbnb, Booking), the contract is concluded through the respective platform. For direct bookings, the contract is concluded upon confirmation of the booking by Weekendwise.

3. Prices & Payment: All prices include the applicable statutory sales tax, unless otherwise stated. Payment is made in accordance with the terms agreed upon at the time of booking. Weekendwise is entitled to cancel bookings in the event of non-payment.

4. General Obligations of Use: The guest agrees to treat the accommodation with care, to comply with the house rules, and to report any damage immediately. In the event of violations, the guest is liable for any resulting damage.

5. Short-Term Rental (1–28 Nights):
5.1 Type of Use: This is a short-term accommodation.
5.2 Cancellation: The cancellation policies of the respective booking platform or the booking confirmation apply.
5.3 Stay: Weekendwise is entitled to terminate the stay early in the event of violations of the house rules.

6. Medium-term Rentals (30 nights or more):
6.1 Minimum Stay: The minimum stay is 30 nights.
6.2 Purpose of Use: The property is to be used exclusively for temporary residential purposes. No permanent tenancy agreement within the meaning of residential tenancy law is hereby established.
6.3 Term of the Agreement: The stay is for a fixed term and ends automatically at the agreed time. A tacit extension is excluded. 6.4 Payment: Unless otherwise agreed, rent is payable in advance.
6.5 Termination / Cancellation: Cancellations and changes are subject to the agreed terms and conditions or platform rules. In the event of violations of the Terms and Conditions or house rules, Weekendwise is entitled to terminate the agreement without notice.
6.6 Subletting: Subletting by the guest is prohibited.

7. House Rules (for all stays): Non-smoking accommodations, no overcrowding, pets not allowed, observance of quiet hours, prohibition of illegal activities like prostitution. In the event of a violation, the stay may be terminated immediately and a contractual penalty of 1,000 euros may be imposed.

8. Liability: Weekendwise is liable only for intentional acts and gross negligence. No liability is assumed for items brought in by guests. The guest is liable for all damages caused by him or his traveling companions.

9. Sales Tax: For short-term stays, the reduced sales tax rate may apply. For longer stays, an adjustment to the regular tax rate may be made, if required by law. 

10. Co-Hosting & Services:
10.1 Scope of Services: Depending on the agreement, Weekendwise provides services such as: creating and optimizing listings, communicating with guests, managing pricing, and organizing cleaning and operations.
10.2 Compensation: Compensation is paid in accordance with an individual agreement with the owner.
10.3 Liability: Weekendwise is not liable for outages, booking platforms, or damages caused by guests, provided that Weekendwise is not at fault.

11. Data Protection: The processing of personal data is carried out in accordance with the privacy policy on the website.

12. Final Provisions: German law applies. The place of jurisdiction is, to the extent permitted, the registered office of Weekendwise. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
